The Small and Emerging Small Business Program was created to stimulate the growth of small and emerging businesses in Omaha, with special attention to stimulating economic growth in areas having high levels of poverty. It is a race and gender neutral program.

Businesses are categorized as Tier I and Tier II which is determined based on the location of their headquarters and the location of employees by utilizing this map. They are also further divided based on their North American Industrial Classification System (NAICS) codes and size to determine if they are an "Emerging Small Business" or a "Small Business".

The definitions section below explains the terms "Small Business" and "Emerging Small Business".

The following documents will be required along with the application to be considered for certification:

  1. Copy of the company's last three years Federal Income Tax Returns, including all schedules.
  2. Copy of the last three years Personal Income Tax Returns (1040) for all current owners of the company.
  3. Copy of Driver's License or State issued ID for all owners.
  4. Proof of citizenship (copy of social security card, birth certificate, U.S. passport, or any document that can be used on an I-9 form) or permanent resident alien status for all owners.
  5. If license or permit is required for you to provide product or service, include a copy of each.
  6. Copy of Nebraska Department of Labor contractors/subcontractor registration (if applicable).
  7. Copy of building/office lease/rental agreement for the business site (if applicable).
  8. Copy of Organization set up i.e., Corporation, Limited Liability Company (LLC), Partnership, Joint Venture, Sole Proprietor (Copy of Trade Name).
  9. Copy of current liability insurance and/or bonding certificate.
  10. Provide a list of current employees, including names, addresses, and phone numbers (Tier I applicants only)

Definitions

The term "small business" or “SB,” wherever used in this division, shall mean a business entity that:

(1) Must have a physical working office location within the Omaha Council Bluffs Metropolitan Statistical Area (MSA).  The MSA shall include Cass, Douglas, Sarpy, Saunders, and Washington counties, Nebraska, and Harrison, Mills, and Pottawattamie counties, Iowa; and

 

(2) Is not an affiliate or subsidiary of a business in its field of operation; and

 

(3) Is not:  a manufacturer's representative; a franchise, unless operating as an independent entrepreneur utilizing a franchise name only; a business where the owner is an owner or part owner of another similar business; or, a non-stocking retailer or wholesaler; or

 

(4) Is a construction contractor, including a building constructor or heavy and civil engineering contractor as described in subsections 236 and 237 of the NAICS standard whose average annual gross receipts from the past three years does not exceed the size standard (in million dollars) and/or the size standard in number of employees (25 percent of NAICS code) for those subsections of the NAICS as published in the current U.S. Small Business Administration Table of Small Business Size Standards Matched to North American Industry Classification System Codes; or

 

(5) Is a specialty trade contractor as described in subsection 238 of the NAICS standard whose average annual gross receipts from the past three years does not exceed the size standard (in million dollars) and/or the size standard in number of employees (25 percent of NAICS code) for those subsections of the NAICS as published in the current U.S. Small Business Administration Table of Small Business Size Standards Matched to North American Industry Classification System Codes; or

 

(6) Is an "other contractor" whose average annual gross receipts from the past three years does not exceed the size standard (in million dollars) and/or the size standard in number of employees (25 percent of NAICS code) as published in the current U.S. Small Business Administration Table of Small Business Size Standards Matched to North American Industry Classification System Codes; and

 

(7) The net worth of individual owners may not exceed the sum of $1.32 million (this figure may be subject to change from time to time based upon the rules promulgated by the U.S. Department of Transportation) after excluding the individual's equity in the business seeking certification and the individual's equity in his or her primary residence. As used in this subsection the word "owner" includes any person holding any percentage ownership in the business; and

 

(8) Individual owners may not hold more than 20 percent ownership in any other single business unless the other business(es) is certified by the City of Omaha as a small business or an emerging small business. As used in this subsection the word "owner" includes any person holding any percentage ownership in the business.

 

The term "emerging small business" or "ESB," wherever used in this division shall mean a business entity that:

 

(1) Must have a physical working office location within the Omaha Council Bluffs Metropolitan Statistical Area (MSA).  The MSA shall include Cass, Douglas, Sarpy, Saunders, and Washington counties, Nebraska, and Harrison, Mills, and Pottawattamie counties, Iowa.; and

 

(2) Is not an affiliate or subsidiary of a business in its field of operation; and

 

(3) Is not:  a manufacturer's representative; a franchise, unless operating as an independent entrepreneur utilizing a franchise name only; a business where the owner is an owner or part owner of another similar business; or, a non-stocking retailer or wholesaler; or

(6) Is an "other contractor" whose average annual gross receipts from the past three years does not exceed the size standard (in million dollars) and/or the size standard in number of employees (10 percent of NAICS code) as published in the current U.S. Small Business Administration Table of Small Business Size Standards Matched to North American Industry Classification System Codes; and

 

(7) The net worth of individual owners may not exceed the sum of $1.32 million (this figure may be subject to change from time to time based upon the rules promulgated by the U.S. Department of Transportation) after excluding the individual's equity in the business seeking certification and the individual's equity in his or her primary residence. (8) Individual owners may not hold more than 20 percent ownership in any other single business unless the other business(es) meet the City of Omaha SB or ESB requirements and is certified by the City of Omaha as a small business or an emerging small business. As used in this subsection the word "owner" includes any person holding any percentage ownership in the business.

 "Tier I" ESB or SB is any emerging small business or small business concern that is certified as such by the City of Omaha and,

  1. Has invested in a primary headquarters office or has a physical working office location within a census tract or contiguous area within Douglas County, Nebraska, based upon census data updated at least every ten years beginning in 2010 that shows 30 percent or more of the persons in that census tract are below the poverty level or at least 15 percent of the persons in the contiguous tract are below the poverty level; and
  2. Can show that 20 percent or more of its employees reside in a census tract or contiguous area within Douglas County, Nebraska, based upon census data updated at least every ten years beginning in 2010 that shows 30 percent or more of the persons in that census tract are below the poverty level or at least 15 percent of the persons in the contiguous tract are below the poverty level.

"Tier II" ESB or SB is any emerging small business or small business that is certified as such by the City of Omaha.
